What if someone stole your image and placed it on another forum? Since you issued a complaint here but not on the other forum, is there consent?
No. You have to prove that the circumstances point to silent consent. I'm not on the other forum, so me not saying anything about it doesn't prove anything.

Then there have to be millions of photos on the internet that are illegal.

Some of these laws, if interpreted correctly, seem like clutching at straws to me. One could easily lie and just say that you gave permission to use your photo on another forum.

No, one could not. One would have to prove that there was consent, which is going to be very hard. Therefore we have contracts.

There are millions of photos on the internet that are illegal, yes. But it's not clutching at straws, it's actually very reasonable. You also have to consider that, whilst they are illegal, something will only come from it if you go to court.

You couldn't represent yourself...
No, I probably could not. But you receive financial aid in Belgium if you can't afford a lawyer. And there's left to be seen how much damages you will have to pay.

One could easily write a consent form and forge your signature. That would be illegal, too, yes, but they could still do that.

A site like College Humor must be posting illegal pictures every single day. I knew a weird kid who had a boner at a pool party while standing behind some girls, a picture that was posted on College Humor. When he was shown the photo, he didn't know what to do, so someone suggested contacting the site admin.

One has to wonder how this website still exists. They must have several lawsuits pending against them.

Of course you could write a consent form and forge my signature. But they could do that for just about anything. That way they could sell your house too. I really don't see why you're using it in this particular debate.

Sites like that often have problems yes. What they also do very often is make the persons who upload the pictures liable, instead of the site.

Obviously you are, you, once again, didn't get it.

Could you imagine Seven trying to sue Burke over photos posted on this forum? That would be fucking hilarious.
Obviously I'm not planning on doing so, but if he would continue to use my image for many months without me approving, I don't see why I shouldn't.
