Seems to me that the whole point of Burke even sporting Andries' photo is because he know Andries can't ignore it. (The irony being this isn't terribly like the baiting Andries often gives...and receives.)

Let me have an offline chat here. I think we've all wasted more than enough time on this already.

Andries, you're legally in the right here, but it's not like you're in a French maid's costume here. Your best bet is to ignore it.
So you tell me why Burke is still a moderator. I think that my initial reaction was more than civil, Burke should have taken it down. If he doesn't take it down, he should resign.

He studied law. He's not a lawyer yet.
I study law too. Just had an exam about intellectual property. Therefore I find it kind of funny that someone says facebook is public domain. Is Adidas public domain too? And that's not even the point: no matter where and how he obtained the picture he should have my permission.

I could imagine Burke in court:

"But it's a piiicture of a piiiicture"

I'm not a mod any more, so I have no say in the matter.

If you feel strongly that he should be removed, write a short, calm pm stating your case to Greg or one of the other mods. They'll discuss it privately.

Similarly, as this site is hosting copyright infringing material (the photo), if you request that the mods remove Burke's avatar, they will probably feel obliged to do so in order to protect the site from potential action. It is one of their functions as mods.

I knew it was only a matter of time before that was brought up.

I'd wager to say there are a few hundred, if not thousand, pictures on this forum that fall under this same definition of illegal.

Not quite. One assumes that there is consent when there is no complaint. However, here there is a complaint so there is no consent so Burke cannot use the image.

It's all very easy.
