OSHA can shut down factories and rightfully so.

I’ve worked in manufacturing and ops needs to be scared of being shut down for not providing safe working environment to their employees, otherwise they’ll try to get away with anything.
Factories, sure. Entire industries? No. OSHA simply does not have that authority. And if we give it to them (and by precedent other "fourth branch" unelected unaccountable agencies), they will come for other stuff next. Because they need to justify their existence.

Climate change is a concern, make no mistake, but giving OSHA this power is NOT the way to go. Same as the vaccine mandate stuff. COVID is not fun, I've had it (while vaccinated) and it was awful. But giving OSHA the power to mandate vaccines is an expansion of executive power so over-the-top it would have made George W Bush blush.

Nothing is going to "force" Congress to come to agreements and do work, let's be real.
WE have to force them, by electing more reasonable people who will work with each other instead of against each other. It's hard as hell though, I'll grant that.

IMO we should get rid of the primary process (which rewards more extreme candidates) and crack down harder on partisan gerrymandering (which the GOP used to excel at, but now both parties are now doing with gusto)

Edit: Also maybe term limits for congress. Say, 3 terms max? 4? Might do more harm than good, but should at least be explored.

Unpopular opinion, but we should always have someone like Dick Cheney or John Bolton somewhere on staff in the executive branch. We don't have to listen to their suggestions all the time, but without them, other countries know that they can fuck around and not find out. Our enemies should at least have a credible fear that if they fuck around, well, they might find out.

Don’t get me wrong, I’d love Congress to actually do something productive. That would be to the huge benefit of the nation.

I think an interesting question is as follows. Should Congress actually legislate that I have to wear a hard hat on a job site or can we trust OSHA to assume that was inferred by broader legislation even though it’s may not be specifically mentioned? Or do we insist Congress amend the law to include specific hard had regulations?

I dont know if OSHA making people wear helmets for safety is the same as the EPA ruling what businesses can and cannot exist is the same.

I'd have to do more research into it. OSHA safety regulations result in fines. They don't kill entire industries on a whim.

You cannot take major actions on a whim. You must have clear direction from Congress in the form of law.

So yes, if OSHA told businesses that if they didn't wear helmets their INDUSTRY would be closed I would think OSHA would be beyond their power.

Helmet rules from OSHA and EPA shutting down and killing industries through regulation don't seem like for like. But again, I'd need to research it more. And if you ask "is that what the EPA is really doing" clearly this Supreme Court ruling says yes thats what they were doing. Otherwise it wouldn't have been brought before the SC.

If you're trying to kill an entire industry, do it with law. Don't hide behind an agency you created to make such sweeping changes and kill an industry.
The Roberts quote is good. If Congress wants something done, do it themselves and not let whichever party is in power to force changes by people appointed to said agencies that are placed there to do a narrative of the party in power.
