Only if the referee decides it is, if there's no intent it comes down to his interpretation. The majority of referees won't give fouls nor penalties in situations like that.

It's still an intentional hand ball, if i raise my arms to the ball that is a foul there is no discussion to be had here. The only refs that wont give that are the refs without balls.
