Juve defence lawyers were previously denied access to note containing conversation between figc prosecutor chine and Covisoc. TAR court have now said that Juve lawyers can have it and use it as evidence. That note would mean that the timeframe for an investigation into capital gains has passed and is outside the time allowed. (Tuttojuve)

there's a document that chiné never let juventus see despite the club asking for it. it's supposedly a letter between covisoc and chiné, and depending on what's written there, that could backdate the whole process, and also that could mean that the whole penalty was invalid. if that's true then it's no wonder that sneaky little romanista prick did his best to hide it from juventus and the public. it's been all over the news yesterday, but there were rumors about it for months

Ok i understand it now, but isnt it too late anyway? The appeal was already made with arguments known before the reveal of this document - i guess they cant add new info to it now, so it wont contain any arguments based on this documents? dont think its coincidence that the TAR agrees to give to Juve at this very moment when they already sent the appeal, fuckers.

The letter reportedly outlines a request from Covisoc to the FIGC for clarification on the capital gains case relating to Juventus and is dated April 14, 2021. For Juventus, this document represents the real beginning of the investigation into capital gains, and would therefore be able to invalidate the investigation of the federal prosecutor’s office, which took place after the time allowed.

The proceedings were in fact opened in October, well beyond the allowed time limits, namely 30 days for the entry of the notice in the appropriate register and 60 days for the duration of the investigation.

Covisoc will now have to deliver the document to Juve’s lawyers within seven days. So far, the Bianconeri had asked to see the document, but prosecutor Giuseppe Chinè had rejected the request, explaining that “it is not part of the documentation acquired as part of the disciplinary proceedings.”

Covisoc, in the documents of the appeal to the Tar defended itself, saying: “The document to which you request access was formed by the Federal Prosecutor’s Office. Your petition was promptly addressed to that body to the extent of its competence. Please refer to the Federal Prosecutor’s Office, which will be able to fully express itself on the formalized petition.”

The lawyers had emphasized “the interest in defensive access in the case at hand, particularly in the pendency of the appeal of the revocation ruling, issued by the Federal Court of Appeal, precisely because the act must be known before the conclusion of the sports trial.

The appeal hearing is expected to continue until at least the end of the month before a definitive verdict is reached.

it would make the appeal pointless as the whole process would be invalid

procedural errors are the best hope for juventus as they won't require any reasoning or subjective evaluation. it would mean that the whole process was unlawful, and also the rulings would be invalid by definition

Apparently the number of deactivations reached 700 000. It's millions of euros lost every month for DAZN. Apparently, DAZN is no longer interested in renewing the deal for TV rights and companies like RAI, Sky or Mediaset won't bid neither before the situation with Juve clears out.

Obviously I'm not an Italian lawyer and I'm not familiar with this particular procedure at all.

But usually you are allowed to outline your arguments in the first appeal brief. The arguments you set out delineate the borders of the appeal. However these borders are usually broad. E.g. you'd say that the proceedings were opened beyond the time limit. During the appeal hearings you can then present your case as to why you feel the proceedings were opened too late. Any evidence pertaining to this argument can be presented during the hearing. This would mean they can still use the document as long as they initially made the argument that the proceedings were opened too late.

This is, of course, only my experience in the Belgian legal system (which is likely to be similar to the Italian legal system however).

Yeah but they needed like 5 hrs to punish us. I hear FIGC won't attend the hearing.

Really does belgium courts also consider principles of transparency fairness and morality while handing out judicial sentences.

because he is so funny, he is Napoli fan, but 95 % of his "articles" are Juve related, he writes about everything Juve does, he definitely has an obsession on our club.
TBF i would love to see his meltdown, dunno about u guys.
