It wasn't and it wasn't their song to use. I have no issue with people using samples - as long at the writter is given what they are owed...they wrote it. Also the stones are only getting royalties, they aren't getting all of the money, the song has enough differences for it not to be given completely to the stones - also iirc it was a brian jones song so the money will be going to his estate, which i believe goes to charity.

They weren't guilty of ripping off the song, they were guilty of ripping of the orchestral parts. And if we want to get really down to business, the Stones ripped off Staple Singers, a 50's band. Even the intro of Bittersweet Symphony is original, they just sampled a part of the orchestral sound which was 1 tone too long, iirc.
