Luis Fabiano is taking Sevilla to court in London to ensure he is released to Milan for £12.5m due to 'breach of contract.’

Reports in Italian, Spanish and Brazilian newspapers today claim the Rio business who own 65 per cent of the player have begun legal action.

There is a clause in his contract that states Sevilla must release the striker if an offer greater than £9m is received, so they cannot legally reject the £12.5m bid by Milan.

The reports state that lawyer Graham Shear – who represented Michael Owen in his case for Newcastle United in 2006 – has been put in charge of the case.

It will be taken to the Queen’s Bench Division of the High Court in London, a section of the Royal Courts of Justice that specialises in cases of breach of contract.

For obvious reasons, the Rossoneri are trying to steer well clear of any controversy by taking a step back.

Vice-President Adriano Galliani already stated that he had only met the Rio representatives as “a courtesy meeting” and all negotiations for Luis Fabiano would be directly with Sevilla.

This is sad. Even for a club like Milan. The difference between what Milan offer and what Sevilla are asking is "only" 3.5 million. Milan don't want to pay these 3.5m, they don't want to give more than 12.5m eur (for Brazil's starting XI striker) and they made him take Sevilla to court.

They just made sure Sevilla never to do business with them, and probably many other teams won't like to do business with Milan anymore.

Lord knows the Milan hierarchy have been embarrassing lately, but this really does take the cake. First they declare Luis Fabiano is their only transfer target, then refuse to raise the offer above a pathetic – by today’s standards - £12.5m for the Confederations Cup top scorer and number one Brazil striker. Now it emerges they may well be surreptitiously taking Sevilla to court via Rio, the company that owns 65 per cent of Fabiano’s contract. This is not cool.

When clubs start resorting to such dirty tactics, it feels deeply wrong and what’s more impossible suddenly to decry the behaviour of other sides, as Milan so famously did when Real Madrid tried to tap up Kaka in recent years. It is particularly unforgivable when Luis Fabiano would have been available for around £16m – hardly a huge figure – and the Rossoneri just pocketed £56m for Kaka.

That is money, by the way, that has not been spent at all. Oguchi Onyewu arrived on a free transfer, Thiago Silva was signed in January, while all the other newcomers like Massimo Oddo, Ignazio Abate and Davide Di Gennaro are returning from loan spells. Having lost Kaka, Paolo Maldini, Philippe Senderos and Andriy Shevchenko over the summer, it is no time to be penny-pinching like this. It’s embarrassing for what was once the biggest club in Europe to be massively out-spent by Genoa and Palermo. If they can balance the books, why can’t Milan?

Let us not even get started on the lack of world class reinforcements in defence or the inexplicable presence of Giuseppe Favalli. Adriano Galliani and Silvio Berlusconi aren’t just running this side into the ground, they are sullying its image at home and abroad. I never thought I’d say this, but at the moment I am embarrassed to be a Milanista.

I dont see the harm in what milan is doing,running a football club is basically running a business & if one can pay less than expected,why not?Ultimately its Sevilla's fault for not ironing out stupid cluases like that in their contracts with players.They have lawyers & pay them handsomely to avoid such embarrassing scenarios.

On a footballing aspect,of course meelan are shooting themselves in the foot.Kinda reminds me of Moggi & Bayern Munich.

Right now the chances of winning the scudetto are about 40% with Inter 59% and all the other teams 1% combined
If Inter exchange Eto and Ibra and do not sign anyone else than I say it is 50% Inter 49% Juve and 1% other
(If we buy a LB the % would change ofcourse)

Juventus general manager Jean-Claude Blanc believes Serie A will be “more entertaining” with Samuel Eto’o instead of Zlatan Ibrahimovic.

Inter and Barcelona have agreed to exchange strikers plus £40m and the loan of Aleksandr Hleb, though they must first work out personal terms.

Many say this will weaken the reigning Italian champions and give Juve a far better chance of winning the Scudetto.

“I wouldn’t say that,” warned Bianconeri chief Blanc. “If Eto’o arrived to replace the Swede, then it wouldn’t be that bad for them, would it?

“Let us just say that without Ibra the League could be more entertaining.”

Last season Juventus finished second to Inter and have reinforced significantly over the summer with Diego, Felipe Melo and Fabio Cannavaro.

As Milan have sold Kaka and Inter get set to release Ibrahimovic, does this make the Turin giants favourites?

“We are focused only on our own squad and getting the best results,” added director of sport Alessio Secco.

“Naturally, an Inter without Ibrahimovic would be a step in the right direction for us.”

I thought he meant that the leagye would be more competitive now as inter are weaker without him.
I think so too :agree:
But still i dont want Ibra to leave inter as stange as it sounds i think winning the scudetto with Ibra in Inter's ranks would give all juve ultras great satisfaction...i just love to see that look at his face, u know the one he has when he loses :D
