Let me get this straight. Our request was rejected not because we had no moral, ethical or legal grounds to the scudetto, but because the statute of limitations ran out?

Out of curiosity, when was this expiry date?

It sounds like it. Only in Italy will you find such a justice system.

if we had made a serious case out of this in 2006 then we would have been punished just the same.

the FIGC would have accelerated everything and found as guilty even quicker and they would have had the backing of the italian football fans, because the FIGC could say "see those juventus directors ? they are to blame that our national squad is not participating in the world cup and they are responsible for the season the be postponed". they would have surpressed any important evidence anyways...

thats just how this crooked italy is, sadly.

I just don't fucking understand why this club/moggi can't just take the case out of Italy altogether. What the fuck is so hard about that?

Because you generally can't just jump straight to European Courts.

You need to go up through the courts in your own country first.

Also, none of this stuff is really about European law.

1.) I was doing research and it sounds like Europe has laws within the EU that protects sports, etc. Am I wrong and misread it?
2.) Haven't we gone through our own courts already? After this decision what would be the next court?
3.) What is the point of the EU if a business institution has no protection in it's own country? That makes the EU pretty useless then, no?

1. Juve could maybe go to the Court of Arbitration for Sport.

2. Juve didn't appeal the decision or anything to take the case up through the Italian courts system.

3. What aspect of EU law is relevant to Calciopoli?

Edit: As it is apparently, they didn't say anything about the scudetto, but the statement said that there will be no new punishments vs people or teams.
but still the decision on the 2006 scudetto not yet decided. At least thats what i understood.

even if we went to the european courts, they still cant revoke/return the scudetti taken from us, only the sporting courts in Italy can do that. effectively speaking by going to the european courts would be pointless as clearing our name (if that was the outcome) would only fall upon deaf ears in Italy

L’atto di archiviazione dell’indagine sulle telefonate sfuggite è un clamoroso atto di autoaccusa della Figc, e in particolare del procuratore Palazzi, che ora non può non rassegnare le sue dimissioni. Notate la litote, che fa il verso alla figura retorica prediletta dal procuratore federale, il quale pilatescamente, nel suo documento scrive "non ci sono fatti di rilievo disciplinare che non siano improcedibili per prescrizione". Ossia descrive e mette in luce quello che non c'è e che sarebbe necessario per procedere, sfumando su quel che c'è.

La prescrizione è da considerare una manna per i soggetti incolpati ed allo stesso tempo una chiara colpa degli organi federali inquirenti che negli ultimi 15 mesi hanno letteralmente dormito, con l'aggravante che queste intercettazioni avrebbero potuto essere richieste a Napoli nel 2006, come ai tempi sollecitò lo stesso Borrelli.

Entrando nel merito del documento pubblicato ieri, e che sui media ha alimentato un dibattito incentrato sulla quérelle dello scudetto di cartone, c’è da evidenziare che in realtà non riassume solo le posizioni di Moratti e di Facchetti, ma anche quelle di altri 12 dirigenti di società (ben 8 uscite pulite nel 2006: Palermo, Atalanta, Cagliari, Chievo, Udinese, Vicenza, Empoli, Livorno; più Reggina e Milan che erano già state punite), dell’arbitro De Santis e dei designatori Bergamo, Pairetto e Mazzei. 18 tesserati in tutto, tra i quali gli unici prosciolti con “formula piena”, e cioè “perché non sussistono fatti di rilevanza disciplinare”, risultano Zamparini, Zanzi (Atalanta) e De Santis. Dal gergo palazzese si capisce che tutti gli altri avevano elementi di reato sportivo non perseguibili solo per sopraggiunta prescrizione. Su Foti e Meani, già giudicati nel 2006, si specifica che riguardo al primo sono emersi fatti su cui in realtà è già stato giudicato, mentre riguardo al secondo sono emersi fatti nuovi che avrebbero aggravato la sua posizione.

Tutto il procedimento viene così archiviato perché tutti gli indagati non sono procedibili, chi per prescrizione e chi perché è innocente. Ma che bisogno c’era di attendere un anno e tre mesi per arrivare a questa conclusione? Dalla Figc abbiamo appreso che questa indagine era partita prima dell’esposto Juve e che si è voluto aspettare le trascrizioni ufficiali del tribunale. A parte che i files audio, più eloquenti di qualunque trascrizione, erano in circolazione fin da subito. Comunque. Proviamo fare un’elementare comparazione.

So why did it take 1 year & 3 months to reach this conclusion? The FIGC have said they started this investigation before Juventus's appeal and that they wanted to wait for the official transcripts from the trial. But the audio files, and a few select transcripts, were available to them from the very start.

Ne risultano almeno quattro importanti conseguenze:

1. Nel 2006 si è svolto un processo monco e se la procura di Napoli avesse passato certe telefonate un altro lungo elenco di società e dirigenti sarebbero andate a processo. In pratica, quasi tutta la serie A.

In 2006 there was an incomplete investigation and if the Naples prosecutor had taken into account all the other telephone conversations many other clubs and employees would have been involved. Practically all the other clubs in Serie A.

2. L'Inter ha commesso atti da deferimento e questo rafforza la tesi che quello scudetto va tolto, dato che lo stesso Abete ha detto che l'etica non va in prescrizione.

3. L'unico vero campionato falsato in questa vicenda è il 2006-2007 perché, usando il metro del 2006, altre società avrebbero dovuto essere giudicate, punite, partire con penalizzazioni. La classifica finale 2006/07 sarebbe stata diversa.

The only real fake Championship was the 2006-07 one because many other clubs should have been convicted & punished with relegations & points deductions. Therefore the final standings would have been very different that year.

4. Oltre alle responsabilità della Figc, ci sono quelle di Auricchio e dalla Procura di Napoli, che hanno fatto la selezione delle telefonate. Tutto ciò ha procurato danni a diversi soggetti, pensiamo ai danni economici patiti dalle società di calcio penalizzate dalle sentenze sportive 2006. E se al termine dell'iter processuale gli imputati venissero assolti?

Other than the responsibilty of the FIGC, there is those of Auricchio & the Naples Prosecutor, who selected which calls were investigated. All of this created damage to many clubs & people. Think of the economic losses to the clubs punished because of 2006. And just imagine if at the end of the current Naples trial the accused (including Moggi & co.) are all found innocent?

Particolarmente comiche le minacce interiste di azioni legali in caso di revoca di uno scudetto che non hanno mai vinto, né meritato. Doveroso il comunicato della Juve, che prosegue sulla linea della rivendicazione della nostra storia, intrapresa recentemente.

Sottoscriviamo: il palmarès, quello vero, non cartonato, conquistato sul campo, come da legge dello sport, non si prescrive.

Si rivendica con tutti i mezzi che la ragione e la civiltà ci forniscono.

Nothing has changed since calciopoli, the powers that crippled us still rule, they dont have to make not even a step back, even after so much long period of time, as their hold is still as tight as ever. We are not threat to the ones who control the corrupted FIGC leaders and Italian media.

They barely allow us the minimum circus to appease some of our hard core fans, leading them to believe that we have actually tried to do smth...

i was going to get really annoyed and angry but then i remembered that i said a few days back that i had NO confidence in the Italian legal system and that we would never get a victory in an Italian court,never mind from a organisation as inherently corrupt as the FIGC

i am not angry,simply because this is exactly what i expected

Imo the club and everyone involved needs to let this go and move forward. We won't find any redemption whatever the outcome is. What's in the past is in the past, now we seriously need to look forward. Our troubles right now won't be solved by solving what's in the past. I also think this could somewhat annoy the players today. As Chiellini commented it seemed like it was frustrating the player/s that the board took so much effort on this issue, these kind of statements from the players are worrying. Move on and look forward, not backwards. We can't solve what's in the past, our current matters and out future difficulties at the same time. Each matter solely is difficult enough to be solved so there's no need to make it even more difficult. Looking at our results the past two years it hasn't really helped anyhow.

I know most of you disagree but this is my opinion.

Still don't understand why after this is all said in done in Italy we don't take it to an EU court for an honest round in a court of law. I guess we have to go through all of the levels in Italy first. Does anyone know how many other levels there are?
