It may take a while but if conte is found guilty and we appeal it in a civil court will contes assumed ban be implemented or would it be put on hold till the civil courts verdict be reached?

I hope he doesn't bargain and his lawyers take it to civil court.

I guess the ban will be implemented and he might have it aborted after a couple of months if the civil court operates quickly enough.

The more I think about it, I too think he shouldn't bargain and keep claiming that he knew nothing and hope that his lawyers destroy Carrobio in civil court quickly.

He should stick with his original statement, that he knew nothing. I'd rather have him miss one year than missing only six months by admitting that he lied in court.

If he is given a guilty verdict in the sporting court trial, he will have to serve any punishment that they come up with. There is no appeal option necessarily, he can 'appeal' it with the choice to sue the Sporting Justice Committee in a Civil court over their verdict and proceedings.. which will take time and will be a costly and lengthly process. This is what moggi is doing.. it's a different thing all-together.. In the meantime, he will have to serve whatever 'ban' until the lawsuit in the civil court says otherwise.

Like someone else mentioned.. his ban would be over before the civil trial probably even begins. All this is why his lawyers are advising him to go for a plea bargain and just be done with it.

Depends on the Italian civil system, but I'm sure you could ask for an interim measure to suspend the ban until the civil court rules on the issue, you could potentially plead the ECHR or even better the Charter of Fundamental Rights to claim that the sporting trials did not offer fair procedural guarantees, similar to right to a fair trial in Article 6 ECHR but which applies only to criminal or civil obligations. It could be argued whether this is a civil obligation, but then you could perhaps bypass that by pleading the Charter and trying to introduce the fair trial guarantees through the freedom to conduct a business / profession.

We don't know any of the facts or evidence against Conte - so I can't say how likely it is or isn't. But a hefty fine for failing to report an attempt to fix a match is a very realistic outcome if he is even found guilty of that charge. Because a fine would be likely - all the more reason to go for a plea bargain now, then wait 2-4 months to found out you have a huge fine.

I have no idea, this is just speculation and legal hypothesis on what could potentially perhaps be done.

Still, while this could perhaps be a very interesting case from a legal perspective in order to determine a precedent you'd still most probably have to go through several instances and it would likely take too long to have any significance for Conte.

Conte has a very modest charge. If found guilty, a large fine would be the most likely outcome -- not a ban. The only Juve-associated person with a serious charge is Bonucci. Thus why Juve are on full-blown getting a centre-back mode.

I would hate to lose Bonucci,but I still feel that with good lawyer-ing and he may still get a smaller amount of Ban,less than the 3 years that is circling around. But to lose Conte,even for just 3 months,that is terrifying!
