Zé, my pilot brother. Dumb question, but why would commercial aircraft even allow pilots to turn off a transponder and all communications to begin with?
I can't think of any scenario where they'd allow an airliner to do so. Latest I read is that it the transponder was deliberately turned off...nothing at the request of ATC.
