He was less than three meters away from his opponent, i think the yellow was harsh.
It doesn't apply here because he deliberately handled the ball. I say it again, I don't know if handling the ball intentionally must be punished with a yellow card or not but I'm sure it was intentional.

It was intentional handball. The bad thing is that just a second earlier Messi clearly handled the ball too, couldn't control it and neither could Muller who also handled it.
Unfortunately for Muller, Messi had his back towards the ref and he didn't. The ref saw Muller's and didn't see Messi's hand ball. If he did the action would have been stopped there and Muller wasn't gonna get a yellow.

You know that saying something like that in football is way off base. There are many such "if"s any of which could easily change the whole game by that logic.

he clearly saw di maria's handball tho & did nothing! di maria's was the most blatant

Yea I think he saw it but he decided to let it go because it was too early in the game. Not saying that he made the right decision (and of course Di Maria's handball was much more blatant than Muller's) but I know many referees who prefer to not give out cards early in the game.
