I don't really think it matters "what" you swear on as it pertains to a court of law.

What if you refuse? What if you tell them you'll tell the truth but you think swearing is silly?

You can do that too. The judge may get annoyed with you but people have refused to swear in the past and have had the court be happy with "I promise to tell the truth". Though pissing off judges isn't something to do when your about to be questioned open court.

You say something to the effect, "I will not lie to you and everything I say is truthful as far as I know, or to my best ability and recollection."

You can do that, but saying testicles to be a smart ass in a court room is probably going to get you close to contempt of court unless it's part of testimony. A night in jail is not something one should aspire to.

Exactly, it's the power relationship that keeps this antiquated custom in place. If not for that lots more people would snub it.
