Adrian Mutu has lost his appeal to the CAS and will now have to pay compensation to Chelsea following his controversial sacking.


The Romanian’s deal was terminated in October 2004 after he tested positive for cocaine, but believed he had not committed a unilateral breach of contract.


He joined Juventus as a free agent in January, prompting Chelsea to request an £8m compensation package.


Today the Court of Arbitration for Sport (CAS) ruled against the former Parma and Verona man, also ordering that legal costs will be on Mutu’s head for a further £9m.


“The player’s admitted use of cocaine constitutes the 'unilateral breach without just cause’ provided by the FIFA regulations and triggers the consequences deriving thereof, no matter whether this breach causes the club to give notice of termination or whether the club continues to hold on to and insist upon performance of the contract despite the player's breach," said a statement.


Chelsea had paid £15.8m to take Mutu from Parma in August 2003, but his time in the Premiership was blighted by injury and personal problems. A new appeal to the CAS is possible and Juventus have already stated the matter is between the player and Chelsea.

I think that firing him was their personal decision. And when you take one, you have to think about the side effects. They could have fined him and sold him to another club, if they didn't want to have anything to do with him anymore. But they fired him, and lost any right they had on him, even though they didn't have to -it was like a luxury-. And now what? They want the money they lost by firing him back?

Or maybe they just don't want to be those that got rid of a player that, with some rehabilitation, could have been still important to the team?

But shouldn't you think of that...perhaps BEFORE you throw the contract out the window? If you cancel the contract that's that, no matter what is right or wrong...at least thats the way it should be.

Now I believe that's exactly what Bosman changed. They cancelled Mutu's contract, so basically Mutu was earning shit until Juve came along. And now they're claiming he couldn't have gone to Juve without paying any fee although he DID NOT have a contract at Chelsea. So they won't compensation for a player who they didn't only not owned anymore, but who they also fired.

chelsea released him, so y do they want compensation??? if that was there intention all along (which i highly doubt), they should have kept him on the team as a bench player and make him clean himself up. the only reason their bitching for money is because they realized they screwed up by firing him. they look at him at juve, sober and playing well, and wish they didn't release him so prematurely.

FIFA TOLD TO DECIDE MUTU COMPENSATION


Chelsea have won a crucial decision in their battle to force former striker Adrian Mutu to pay them compensation.

The 28-year-old Romanian had his contract terminated by the Blues after he tested positive for cocaine in October 2004.

The Court of Arbitration for Sport (CAS) in Lausanne ruled on Tuesday that FIFA should decide on a compensation figure for Mutu to pay Chelsea for breaching the terms of his contract.

A statement from CAS said: "CAS has upheld the appeal filed by Chelsea FC against a decision rendered on 26 October 2006 by the FIFA Dispute Resolution Chamber (DRC) concerning the Romanian football player, Adrian Mutu.

"In its decision, the FIFA DRC denied jurisdiction to determine what sporting sanction and/or financial compensation should be imposed upon the player further to the breach of his contract with Chelsea FC."

Mutu, who had cost Chelsea £15million, signed for Juventus on a free transfer during his seven-month ban, and was then sold to Fiorentina in 2006 for £5.5million.

Chelsea successfully claimed Mutu had breached the terms of his contract by failing the drugs test and called on FIFA to rule on a compensation figure the player should pay them.

Mutu argued that he should not be liable to pay any compensation and FIFA insisted they did not have the jurisdiction to make any order.

But Chelsea appealed to CAS, who have backed their claim and FIFA will now have no option but determine a compensation figure.

It is the second time Mutu has lost a CAS ruling - two years ago he unsuccessfully claimed the cocaine test did not mean he had breached the terms of his contract.
