In term of the FA, perhaps. Not the courts. The maximum for a racially aggravated public order offence is 10 years, although those are extreme cases unlike Terry's, and people rarely get more than 2. He won't get a prison sentence, but it's not as if he is not being punished by going through the courts. We shouldn't just think about this in terms of games and football.
