Seriously, you can't pull your leg up that way in that part of the pitch and don't expect a defender to come near the ball in a situation like that. I think Nani's reaction convinced the ref with his intentions.
Yes and he even knew the defender was comming in, he was looking at the ball afterwards, but he took the risk, knowing the defender came.

Exactly, he didnt go right away to apologize or anything like that. He threw down on the floor and acted like he was shot in the chest.

Yes. But those elbows on headers always earn a yellow card unless the player pulls a De Rossi on McBride and tries to splatter his brains, which is intent.

There is no power behind Nani's leg, he's trying to cradle a ball. It's not a stamp or a tackle! It's just a loose foot. It doesn't even hurt. His leg recoils instantly because it's just a limp leg trying to take a ball down.
what if that was giovinco defending and studs caught his eye?

"A player is guilty of serious foul play if he uses excessive force or brutality against an opponent when challenging for the ball when it is in play.
“Using excessive force” means that the player has far exceeded the necessary use of force and is in danger of injuring his opponent"
