Removing a punishment to accomodate the innocent means that you also unwillingly accomodate the guilty.Im not talking about Capital Punishment alone here,but all sorts of punishments.I wouldnt say that every Murder case is different.The reasons behind murder are not inifiniate in number.Theoretically,there is a precedent in Law.You cannot go against a ruling given in the past on a similar case that you are handling at present.I fully go by the 'innocent until proven guilty' notion,which is why i mentioned on the last page that a person who has been correctly found guilty of murder,should be executed,but if there is even a shred of doubt in the entire case,then he is innocent and he should avoid punishment.The system of justice cannot be 100% flawless everytime,but there will be transparent cases from time to time,and the murderer in these transparent cases should not escape execution simply because the punishment was removed to protect the innocent.
The point of my post was that no justice system can ever be perfect, therefore you can't always be assured that an execution is just.

The reason for murder is simple to kill someone. But the why and how, in short the motives and means to the barbarous ends are a multitude. You yourself said that every case is different. For that reason, it is difficult and almost impossible to set a precedent in a capital case. You really can't say that even though a person committed a Type A crime, the penalty should be the same as another Type A crime. Which is why the death penalty is only asked for under certain circumstances.

You argue against executing those who were found not guilty and I have to agree. Though I don't think the argument is whether it's ok to execute innocent men. The is no contest, if someone is going to be executed, they should probably first be found guilty. My only problem, is what about those guys who end up getting sentenced to death when they shouldn't. For whatever reason, those things happen. Perhaps you're willing to "take one for the team" but I surely am not.

The very job of the Justice system is to protect the innocent through enforcement of the law. The death penalty can inhibit that enforcement. I know this probably off topic, but the costs of death row inmates are astronomical. And considering they basically sit around for 15-20 years before their execution. It would be far more productive on an economic level to involve them in a prisoner work program for the rest of their lives.

which is why I only believe you should convict someone to die when you are absolutely sure
there can be no room for error
too many innocents have died
I'm not against the capital punishment but I think it can only be a last resort
