Waited to appeal the ban until 1 hour after Spanish CAS (TAD) had met on Friday so they couldn't rule on the appeal then.

Now TAD has been unable to locate two members to meet today, so they cancelled the meeting and said they will send note to Barca explaining why Neymar cannot play on Sunday.

However, if no word from the TAD is forthcoming Barcelona could elect to field the Brazilian in the Bernabéu, which in turn could lead to Real Madrid protesting about an ineligible player being used as Neymar is still serving a ban imposed by the last body to handle the matter, the Spanish Football Federation's appeals committee.

Barcelona had employed a risky strategy in a final attempt to have Neymar’s three-match ban temporarily suspended so that the Brazilian forward will be cleared to play in Sunday’s Clásico against Real Madrid at the Bernabéu.

On Friday Barcelona lodged an appeal with the TAD at 16:00 CET, an hour after the committee had terminated its daily meeting. The Catalan club’s strategy was to meet the timeframe of 48 hours to take the matter to the higher court after its first appeal with the Appeal Committee of the Spanish Football Federation was rejected in the hope that the TAD would not reconvene to study the paperwork, leaving the matter unresolved and Neymar ostensibly cleared to play in the Clásico. The TAD had been expecting an appeal on Friday but stated after their meeting terminated that nothing had arrived by the 15:00 CET deadline.

A contradiction between Spanish Football Federation (FEF) regulations and Article 90 of the Spanish legal code provided the loophole, with the latter stating that the length of time to lodge an appeal stands at 15 days rather than the 48 hours prescribed by the FEF.

wait, his suspension was for a red card, he shouldnt be able to play this match because a red card = sent off + misses next match, so regardless of the decision, he shouldnt be playing this. even if fagca wins the appeal, they wont remove the suspension entirely, just reduce it. no idea how there is any possibility of him playing

TAD had planned to hold an extraordinary meeting to deal with the case at midday on Saturday, but in the end were unable to do so and maintain that Neymar cannot play in the pivotal La Liga match on Sunday.

Instead, TAD released a statement criticising Barca for lodging the appeal once it was common knowledge that their weekly meeting had ended, said Neymar's punishment is still "immediately enforceable" and suggested Barca run the risk of being sanctioned if they field him at the Santiago Bernabeu.

However, Barca have since replied to TAD, releasing their own statement in which they say the one from TAD merely represents the opinion of president, Enrique Arnaldo.

Barca say they are still waiting for the issue to be resolved and add that it is now a given that Arnaldo should not be involved in the deliberation process so that his own opinions do not influence the outcome.

Speaking in a news conference on Saturday, Luis Enrique said he was prepared for the game "with or without Neymar" and backed the club's approach to the situation, although he wouldn't say if he was optimistic or not.

If things do not progress and there's no definitive ruling, Barca's resolve may be tested when it comes to deciding whether or not to play Neymar against league leaders Madrid.

The club feel that as things stand they are entitled to play him while the issue remains unresolved, although Arnaldo made it quite clear that he feels otherwise.

:agree: However, at some point it's gonna have to end. Real are going all out for La Liga, and ATM have nothing to play for but the CL. I actually think we might see a 1-1 and 0-0 with Atletico going thru on away goals, or possibly two 1-1 games and ATM sneaking thru on penalties. Madrid deserve to be eliminated after the refereeing fiasco in the previous round.

felt so bad for Atleti after they eliminated Barfa and Bayern only to be ko'd by penalties and an offside goal against a Madrid team which had a Europa route.

Nope. Apparently Barca put of a statement today saying they will not play him.

“Against the uncertainty due to the lack of reply from TAD with 12 hours to go until the game, and to focus all attention on sporting matters, the club have opted not to call up Neymar,” a statement from the club read.

“However, Barcelona expresses its amazement at TAD’s refusal to exercise its jurisdictional functions, something which directly damages both the clubs and the competition itself.”
They purposefully waited to appeal until after TAD had met, and now they complain that TAD couldn't get an emergency meeting set up on the weekend to hear the case, or didn't say Neymar could play pending the appeal. :lol2:
