The Premier League appeals committee have cleared the way for Chelsea to seek compensation in the wake of Adrian Mutu's move to Juventus.
The Blues are seeking to recover £8 million of the £15.8million they paid Parma for the Romanian striker, whom they sacked last October after he’d tested positive for cocaine.

Chelsea say the striker, now with Juventus, broke his contract by persistent misconduct.

The 26-year-old striker is currently serving a worldwide ban which expires in May.

Chelsea circulated a press release on Wednesday which said:

‘Following the Football Association Premier League Appeals Committee decision today, that "the conduct of Adrian Mutu in taking banned drugs was gross misconduct which entitled the club to treat the player’s contract as at an end and amounted to a unilateral breach without just cause or sporting just cause", the club has issued the following statement:

‘Chelsea Football Club is obviously pleased that the Appeals Committee has vindicated the club’s position and opened the door for a compensation claim and sporting sanctions before FIFA’s Dispute Resolution Chamber. Chelsea will continue to pursue the case vigorously as the principle is an important one.’

While Mutu is Chelsea’s opponent in this case, if any damages are eventually awarded it is probable that they would be payable by Juventus.

The Premier League said Chelsea were now entitled to proceed to seek compensation and sporting sanctions from the dispute resolution chamber (DRC) of Fifa. But as well as referring the matter to Fifa, it is possible that Chelsea could even take it to a civil court.

Chelsea wanted to prevent Mutu being able to sign for another club on a free transfer at the end of his seven-month suspension, but he signed for Juventus in February and has been training with them ever since.

Mutu concern at comp claim


Adrian Mutu is fearing the worst after Chelsea were given the green-light to pursue compensation from him.
The Premier League granted Chelsea permission to go through Fifa and claim on Mutu.

The Romanian was sacked by Chelsea after testing positive for a banned substance in October.
The 26-year-old was handed a seven-month worldwide ban after his departure from Stamford Bridge.
However, despite his ban, Mutu agreed a five-year deal with Italian giants Juventus in January and will be free to play next month.

Chelsea have since claimed that Mutu breached his contract with them by taking drugs and now they are looking to recover a sizeable chunk of the £16 million they paid Parma for the striker in 2003.
Mutu, though, is concerned about the ruling and feels it could affect footballers the world over.
"Now, I expect anything (the worst) to happen to me," Mutu told Pro Sport.
"This may create a dangerous precedent, with consequences for all soccer players.
"Employers might fire anyone, anywhere and ask damages for different reasons.
"You wonder how I feel? I feel as anyone would if they were in my place and asked to pay €11.5 million!"

Its not juve that have to pay... If chelsea are found to be right (which they will) then the claim will be at mutu himself... not juve

If we then decide to pay his fine... thats upto us.. we cannot be forced to pay anything.

You say ... well they sacked him.. why should they get anything...

Because in any contract orientated field.. thats the way it works... If it wasnt anyone could purposefully break the terms of their contract so as to allow them to move on.
If you break your contract the company is entitled to claim their losses back... Welcome to the real world.

People then say... hes got all this money.. hes jus greedy etc...
Please.. the money isnt the point.. its the principle

I can afford to pay the wrongfully issued parking ticket i got last week... but i wont.. i will goto caught and get justice

Jus cause you can afford it doesnt mean you jus forget about these issues.

As for those that say fifa will not go with it... Look to ortegas case for a view of their stance... I didnt see too much complaining about that judgement either... not alot of difference in the cases really... Both sacked for breaking their contract and both clubs sought / seek compensation.

Also look at fifas judgement on our own case involving athirson... for an idea which way they will swing.

Mutu did the wrong here... Not chelsea... If you let him go you set a potentially devastating precedent for football in handing all power to the players.... clubs left dangling on the whim of a player

Of course he's breached a rule and that will be used against him. Were Chelsea really forced to sack Mutu though? Don't tell me they had no other choice but to sack him! Don't tell me Mourinho didn't want him out for a long time and jumped on the occasion. Out of 10, how many clubs wouldn't have sacked Mutu? Many, I'd say. How many would rather support and hold on to a player through a difficult period rather than fire him like proper dogsh!t only to impede the said players career to go on with a stupid blackmail for the principle - since it's acquired that they don't need the money and that if loss there was, it'd rather have to do with Abramovich paying twice what's needed in terms of transfers fees. Like they had principles! Asking a player so much money in compensation, perfectly knowing that he won't (be able to) pay and neither shall we, is really acting like total pricks as far as Chelsea's concerned! I hope they get all the bad press they deserve!

Chelsea acted like idiots and sacked him. Now they fear that we will sell him to Roma (in the Cassano deal) and get money. They should have thought of that earlier.

of course the english prem league will allow chelsea to gain compo, they want an english team to gain money back its better for their game.

it doesnt mean uefa will agree with them.
