oh, my mistake, after further observation... i'm wrong about that.
actually if you observe the the triangle above closely, you'll realize the triangle below is bigger thatn the upper one.

well it has only one explanation, the pieces are the same in both diagrams, but the order is different, in fact, to get a right triangle (like in the first pic) from these pieces, there is only one arrangement possible, and the other arrangement is thus wrong... (think of it like a puzzle, when u put wrong pieces together, the puzzle arrangement will show spaces and errors)

The upper figure is not a triangle that is: The 3 points that form the line that is so looks like the hypothenuse of the big triangle are not collinear

    3*5=15
    2*8=16
    16-15=1

Nice notice, that's the correct answer I believe. Just look at the hypotenuses very carefully.
it is straight, its an optical illusion and it appears somehow not straight, but actually it is

Why would they trick us into thinking it's bent, when the whole trick is that it's not straight?

Here, I've constructed a straight line from one point to the other

The dimensions in both are the same. The diference is that in the first one the arrangement has the slant slightly different than the second (follow the boxes' corners).
That allows for a slight change in area.

I know because I'd already seen this before.

Exuse my stupidity, but I am not following...

    What's the slant?
It's like the angle, if you understand. It's how the diagonal line is placed, sort of.
