What can I say? It’s actually been a year or two of action in terms of appeals. The whole scandal revolved around three main accusations (GEA control, International SIM cards, and referee control) which were all dealt with in a matter of weeks by the sporting tribunal as a single group of offenses.

For criminal purposes each were handled individually and a separate trial is taking place right now where all three are again combined and called “Association to Defraud.”

In addition to that Moggi, Giraudo and Bettega were also accused of accounting fraud and a trial took place recently regarding that. This was the only time that Moggi and Giraudo defended themselves together.

In total there have been 5 trials (4 concluded) in the post sporting tribunal relegation period.

The results:

Moggi won the GEA trial. Moggi won the SIM card trial, and the referee control trial basically was abandoned by all because the sporting tribunal itself stated that none existed.

In other words Moggi went 3 for 3. If none if the three elements existed than there essentially couldn’t be “Association to Defraud”. The accusation is now based on three accusations that have been individually dismantled in civil courts.

The trial for Association to Defraud is nonetheless occurring as we speak.

The Accounting Fraud Trial was quick. The defense showed the books and all were acquitted.

Set back:

Moggi and Giraudo kept separate council throughout all trials (except the Accounting Fraud). Moggi intended on defending himself to the utmost and clearing his name and that of Juventus. Giraudo was more interested in walking away from the situation and as a result expended little moey and or energy in his defense. The individual results of the trials may have given him a false sense of security.

The individual trials were actual trials where new evidence was permitted and the defense continued to win as a result. In the Association to Defraud trial the defendants had an option: they could indulge in a lengthy and costly defense or opt for the accelerated verdict which could only be based on the evidence that existed at the time of the initial tribunal. Moggi opted for the long trial. Giraudo (convinced by the results of the prior trials thought it was unnecessary) instead opted for the accelerated verdict and was sentenced to 3 years in jail based on old, outdated and discredited evidence. He has sice launched an appeal meaning he will be able to present new evidence.

Moggi is in trial right now and his lawyers have been destroying the prosecution. A few days ago Auricchio (the police officer in charge of the wires) was all but hung out to dry in court over an 8 hour cross examination that showed the court that evidence may have been handled in the interest of intentionally depicting the Triade as criminal negating a fair trial from the onset.

They even unearthed evidence of missing Inter wiretaps which prove that the evidence was not total and must have been manipulated. In other words, only the calls that painted an ugly picture for Juve were permitted, those that incriminated other teams like Inter or confirmed Juve’s innocence were potentially removed. This was an argument that the defendants made years ago and prosecutors always insisted that all calls were presented as evidence. Now the court knows that was a lie.

Moggi’s lawyers have been doing such a good job that the prosecutors have embarked on a stalling tactic for months. Moggi has accused them of doing this to force a mistrial (an appeal has an expiration date that if exceeded kills the appeal).

As far as justice is concerned…don’t hold you breathe. No matter what this is still happening in Italy where logic takes a backseat to money. For as long as Moratti and Tronchetti run the league through their sponsorships, you can count on the league ignoring what happens in Civil Court. Even the European courts would be ignored as much as possible.

Sooner or later there will be a power shift. Someone else will sponsor the league and a new power structure may change the whole landscape.

I think eventually the titles will come back and some money too but it will take forever. For now we’ll have to be happy with the truth emerging and leave it at that. Even that is a hallow victory because the idiots that want to believe we were guilty will always believe that regardless of what truths emerge.

update on the trial in Naples. We'd have 3 more scudetti if these lawyers were defending us in 06.
