From the outcome of the investigations carried out, the Federal Prosecutor, with deed dated 26 April 2016 n. 11769/70
pf. 15-16 AM/SP/ma, the lawyer Manolo Iengo referred to the judgment of this Commission,
at the time of the events Deputy Federal Prosecutor, to answer for the violation of the principles of
loyalty, correctness and probity and the obligation to comply with the federal regulations
and acts referred to in
to art. 1 bis, paragraph 1, of the FIGC Sports Justice Code, with specific reference to
the provisions of art. 2, paragraph 1, letters a) and d), of the Regulation governing the bodies of
Sports Justice of the FIGC referred to in the C.U. no. 110/A, published in Rome on 26 May 2008 e
of the art. 3, paragraph 1, of this Regulation for having compromised the prestige of the office by
itself coated.
In this regard, the Federal Prosecutor reported that a special investigation has been launched in order to
press reports relating to the involvement of the aforementioned Deputy Federal Attorney in a
investigation conducted by the DDA at the Public Prosecutor's Office of Naples on clan interests
Camorristi in the management of methane supply in the Aversano countryside and in relation to conduct
of the President of the Agro-food Consortium of Naples
(CAAN SpA).
In fact, the press had published that the lawyer Manolo Iengo, in exchange for assignments
professional by the CAAN, had procured for the son of the President of this Consortium a
false attestation that had allowed the interested party to participate, despite not having the right to do so
lack of the prescribed requirements, to a regional course for sports managers, organized by
Regional Committee of the FIGC of Campania.
With regard, in particular, to the aforementioned professional assignments, the lawyer Iengo had been drawn to the
provision of compulsory residence outside the Campania region.

They are indeed separate and very often the amateurism shows.

While most of the time these sports tribunals have lawyers in them, there are various ways in which the rights of parties are better protected in actual courts. I'm also not a fan of lawyers becoming judges, because lawyers are partial their entire lives (they defend one party) and judges are supposed to be impartial. It's simply not natural for a lawyer to be impartial.

I agree that the mere fact that they are fans of a certain club does not preclude them from deciding over certain matters. Everyone is a fan. But when you make statemens saying you are against those thieving sons of bitches of Juventus, you obviously can't decide a case where Juventus are accused of financial wrongdoing. I myself could probably judge more or less fairly when it comes to Atalanta or even Napoli, but intellectual honesty would require me to say that I cannot be anywhere near impartial if it comes to Inter. Inter are the only club I hate and if they were to perish tomorrow I would drive to Appiano Gentile and salt the earth of the training ground so that they may never rise again.

That these people did not feel the need to step aside on their own shows they have no moral integrity whatsoever.
fully agree. They’re not even trying to hide it, it’s so in your face. Hopefully this gives us a greater chance when appealing to different courts or actual courts. It’s the equivalent of jury members in the Johnny Depp case publicly tweeting abuse at Amber while the hearings where ongoing.

Real courts vet jury and judges precisely for this reason

I have this image in my head I can't seem to shake.

It's the day of the hearing for whatever grand sports tribunal decides our case (honestly I can't even remember which is which). The entire Italian football world is there. Every president, every sports director of every club wants to see what will go down. Everyone expects Juventus to send a battery of lawyers. The best of the best. They expect to see men in impeccable suits ready for battle. Ready for war.

But there are no lawyers.

It's you. Just you. Juventus have sent you. You in your little Jj tracksuit.
I tell you something now if we even settle on a revised punishment based on the plus valenza case what will you say then? Will you continue to defend the ownership and management? Id fancy my chances to put up a better fight than this management in a court of law if we accept a lighter punishment still.

At this rate I wouldn't be surprise if Jj does exactly this

Their obsessive attitude to Juve is ridiculous. Who goes out and buys a t-shirt about a team they don't support? It's laughable.

It goes far beyond supporting a different team and shows what the case really is about, an agenda to find a way to punish Juve as much as they can despite the facts.

Id take this in a heartbeat over the current process of a prosecutor handing out -9, the judge amplyfying it to -15 and the appeal being reduced to a technical process. Its the most ridiculous thing ever, even more ridiculous than the scenario you described.

At least in this scenario there're court proceedings where those fuckers would have to explain whats the reasoning behind a sporting punishment. So far theyve released a 40 page document to say absolutely nothing on how it created a sporting advantage (they just speculate that it "inevitably did" with 0 basis provided) or how they landed on the -9 and -15. In fact they didnt even mention the added -6.

Coni can overturn everything. The highlight is the obvious violation of rule 63 of the sports justice code. There is growing optimism that Juve penalty will be overturned and justice will be served.

If they dont were fucked, no way theres enough time left in the season to appeal another time elsewhere. Once the season ends we're never getting those points back no matter what we do.

I want to see what the club does if the penalty gets cancelled. If they don’t do anything I don’t think they fully understand what massive reputational hit we took once again (especially internationally).

Besides, we will never know what would have happened in the league if we didn’t get those points deducted until the decision was final. Would Napoli have crumbled once getting closer to the finish line? Would we have stepped up our game? It completely nullified the season for me.

I think we don't know enough to know which course of action is best.

As a lawyer I think it's all bullshit and theoretically we shouldn't settle and destroy them in court.

But it all seems very politically motivated and I'm counting on the people who are in charge of our club (which isn't really necessarily our board) to know whether or not we can win this by fighting on the legal front. Because no lawyer can beat a corrupt judge.

    When is the case?

Yes I was thinking the exact same. I can hate Inter but I’d never spend my money on some ‘Inter merda’ shirt. First of all I’m not 12, and secondly if I spend my money on football related merchandise I want to spend my money on the club I support.

And keep in mind this aren’t average Joes who are bricklayers and go to the stadium every Sunday. This should be educated professionals.

But maybe even worse besides lawyers and judges who are ultras is that apparently this is accepted in Italy. I never realised that this situation was so bad.

someone had a good question the other day (iirc it was probably @Ronn , sorry if it was someone else): how the members of the collegio di garanzia (the famous appeal body) are elected/selected/nominated. i tried to find the answer but had enough of digging. fortunately malagó (coni president) embarrassed himself today, and these guys did the digging properly, so here's the answer:

long story short: the national council of coni elects both the president and the members of the appeal body, after they are proposed by the coni board. no wonder malagó tried to distance himself from this embarrassment lol

We can beat them if we go on the attack and not just defending ourselves, frustratingly the lack of exposure despite social media, despite the media powers Elkann has this is nothing short of scandalous.
